Terms of Service ("Terms")

Last updated: September 19, 2015

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the www.rmillerart.com website (the "Service") operated by Rebecca Miller Art and Illustrations ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Despatch time

We will endeavour to despatch your items within 10 working days, but usually much sooner than this.

Smaller artworks and prints are sent carefully wrapped and packed in flat cardboard boxes. Large prints and paintings will be sent rolled in tubes.

Please note that rolled artworks should be kept flat for several days before framing, to make sure that they are not curled within the frame. Your framer should be able to do this for you.

You are encouraged to familiarise yourself with your rights contained within the Sale of Goods Act 1979, Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999.

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. You expressly agree that Rebecca Miller Art and Illustrations is not responsible for any loss or damage arising from the submission of false or inaccurate information.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. You expressly agree that Rebecca Miller Art and Illustrations cannot accept any liability for loss or damage arising out of such cancellation.

We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

Import duties and taxes

For deliveries to customers based outside the EU, additional taxes can be applied when the goods are imported. These taxes vary according to the countries involved and what is being shipped. You are responsible for paying any import taxes which are due on your purchase.

For information on duty charged for artworks in the country in which you are based, please input the artwork description on this page on Dutycalculator.com.

Couriers are obligated to pay customs for any taxes due when importing an item. They will keep hold of any item until those duties have been paid by the customer and this can result in delays to delivery as well as additional clearance charges levied by the courier.

Unfortunately, we do not offer framing for most of the artworks, as we are not able to mail pictures in a frame with glass in it. The glass is too fragile and is often damaged during shipping.

All of the artwork and imagery on this site (except for where a different author is explicitly referred to, example reference images in blog posts), was created by Rebecca Miller and all copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) of these works are owned by Rebecca Miller. Nothing in the Terms grants you a right or licence to use any trade mark, design right or copyright owned or controlled by Rebecca Miller Art and Illustrations.
